The Council of Ministers has approved a Royal Decree regulating a system designed to cover possible non-payments in housing rental contracts. The measure, which will come into force shortly, will be managed by the autonomous communities under the common regime and by the cities of Ceuta and Melilla.
The aim of the guarantee is to facilitate access to rental accommodation for certain groups, mainly young people under the age of 35 and people considered vulnerable according to the criteria defined by each autonomous community. The coverage may apply to contracts in force on 30 January 2025.
To qualify for the scheme, landlords must meet several requirements: formalise a contract with a tenant belonging to the aforementioned groups; apply a rent that does not exceed the state reference index; deposit the mandatory legal deposit and its updates; and sign with the tenant the commitment relating to the guarantee in accordance with the model approved by the Administration. The autonomous communities may establish additional conditions.
The guarantee will cover unpaid rent, damage to the property and outstanding utility costs. The beneficiaries of this measure will be landlords who meet the requirements and, where applicable, the autonomous communities when they have taken out insurance with the owners.
The Ministry of Housing and Urban Agenda will set up a specific budget line to finance the measure. In addition, the autonomous communities must send half-yearly reports to the Ministry on the coverage applied.
